The Australian Energy Market Agreement provides that the AER, ACCC and AEMC will enter into a memorandum of understanding (MOU), to be endorsed by the Ministerial Council on Energy (MCE).
The MOU was agreed to by the three agencies on 7 October 2005 and endorsed by the MCE on 4 November 2005. The MoU provided that the agencies would review the MoU at intervals of no more than three years. The MoU was updated in July 2009.
The MOU contains provisions relating to cooperation, consultation, information sharing, confidentiality and regular contact between the agencies at a senior level.
