The AER has issued the final regulatory test version 3 and regulatory test application guidelines as required under the National Electricity Rules. The final decision document, including the revised regulatory test, and the application guidelines are provided below.
The AER’s final decision was made following a public consultation process conducted in accordance with the transmission consultation procedures in chapter 6A of the National Electricity Rules. The proposed regulatory test version 3 and proposed application guidelines were published for consultation in July 2007. Submissions closed on Thursday 6 September 2007. The AER received the submissions below. The AER thanks participants who contributed to this consultation process.
The AER has also issued regulatory test dispute resolution guidelines to assist parties in understanding the regulatory test dispute resolution rules and process.
Under the National Electricity Rules, the AER must publish the regulatory investment test for transmission (RIT-T). The RIT-T will replace the regulatory test for transmission investments. The regulatory test will continue to apply to projects which address a need on the distribution network. Further information on the development of the RIT-T can be found at the following link:
The ACCC released the regulatory test in August 2004. In August 2005 the AER adopted the regulatory test when it released its Compendium of electricity transmission regulatory guidelines. This version of the regulatory test no longer applies.
