The Carpentaria Gas Pipeline (CGP) access arrangement contained a ‘review trigger mechanism’ (clause 8.4) which provided for a review of the access arrangement before the scheduled review date if a specified event occurred.
In 2007 the ACCC commenced inquiries into whether a specified event under clause 8.4 had occurred. The ACCC continued to monitor the situation in light of the reversal of the flow of gas on the South West Queensland Pipeline and any possible implications for the CGP access arrangement.
Following the commencement of the National Gas Law in Queensland from 1 July 2008, pipeline services provided by the CGP became subject to light regulation and the access arrangement ceased to apply. Accordingly, the ACCC has ceased its inquiries into whether a trigger event has occurred and will take no further action in relation to this matter.
