The Network Operations and Development Branch deals with aspects of the economic regulation of networks (other than determinations) including: netork access, exemptions, monitoring and reporting the performance of network businesses, network pricing, assessment of cost pass-throughs and contingent projects and development and review of incentive schemes and other guidelines.

The Wholesale Markets Branch monitors the wholesale electricity (NEM) and wholesale gas markets, as well as being responsible for enforcement and compliance in relation to wholesale energy markets.

The Retail Markets Branch will be responsible for the AER's functions under the National Energy Retail Law, which is due to commence on 1 July 2012. This includes authorising retailers, implementing the retailer of last resort scheme, monitoring retail energy markets, enforcement and compliance in retail markets, approving hardship policies, and operating a retail energy price comparison website.
