Enforcement matters
The AER monitors, investigates and enforces compliance with the national energy framework, comprising the National Electricity Law and National Electricity Rules, and the National Gas Law and National Gas Rules . The AER’s core functions and powers in relation to monitoring, investigation and enforcement are set out in section 15 of the Electricity Law and section 27 of the Gas Law.
The AER has taken formal enforcement action in relation to alleged breaches in the wholesale energy markets for the matters listed below. The AER may issue an infringement notice or institute proceedings. The results of the AER’s compliance activities more generally, including reports into events where it has decided not to pursue formal action, are published in Compliance Reports.
The factors that the AER will have regard to when deciding whether to take formal enforcement action are set out in our Compliance and Enforcement—Statement of Approach.
