When to apply for a retail individual exemption

If your energy selling activity does not fall within any of the deemed or registrable retail class exemptions, you need to apply for a retail individual exemption

Individual exemptions are tailored to specific situations, with conditions attached to the exemption where necessary. The AER will decide on any appropriate conditions when assessing your application.

How to apply

Appendix B of the AER’s Exempt Selling Guideline contains information on how to apply for an individual exemption and lists the information you need to provide in your application.

Applications should be made by the entity intending to sell the energy. For instance, if you intend to use a subsidiary to sell energy then the subsidiary will need to apply for an exemption. Please also note, we can only accept exemption applications from existing legal entities. We cannot grant exemptions to entities that have not yet been established.

If you are granted an individual exemption, you will be included on the AER’s public register.
