Whilst the AER is a separate legal entity, it does not hold separate records in its own right and is staffed and resourced by the Australian Competition and Consumer Commission (ACCC) with all relevant records held by the ACCC. Therefore, Freedom of Information (FOI) requests for AER documents are processed by the ACCC’s FOI section.
A FOI request can be lodged with the ACCC.
COVID-19 impact on FOI processing
The ACCC/AER has activated its Business Continuity Plan due to COVID-19 and most staff are working remotely. We expect delays with processing FOI requests during this time.
