Simple Solar Pty Ltd - deemed refusal of individual exemption - 3 February 2016

On 5 January 2016, the AER approved an application from Simple Solar Pty Ltd for an individual exemption from the requirement to hold a retailer authorisation under the National Energy Retail Law.

The AER imposed conditions on Simple Solar's exemption in accordance with section 158 of the National Energy Retail Rules (NERR). Section 161 of the NERR specifies that an applicant must accept the conditions of an exemption within 20 business days after notice of the AER's decision is given, otherwise the exemption is taken to be refused. As the AER has not received notice of acceptance of the conditions from Simple Solar within this time period, the AER therefore takes its exemption to be refused.
