On 13 December 2017, Darwin Distribution System was granted a 5 year Category 2 exemption under Part 23 of the NGR. On 30 November 2022, this exemption was extended until 12 December 2027.
Gas pipeline regulation reforms to the National Gas Law and National Gas Rules were proclaimed in March 2023. Darwin Distribution System's Category 2 exemption under Part 23 was taken to be a Category 2 exemption under Part 10 on the basis that it is a single user pipeline.
On 30 June 2025, NT Gas Distribution Pty Ltd applied for a variation of Darwin Distribution System's Category 2 exemption under Part 10 of the NGR to exclude Darwin to Berrimah transmission pipeline.
On 22 August 2025, Darwin Distribution System's Category 2 exemption under Part 10 of the NGR was varied to exclude Darwin to Berrimah transmission pipeline. This variation has no effect on the expiry date i.e., the exemption still expires on 12 December 2027.
