On 22 December 2022, the Australian Energy Regulator (AER) approved Elanor Funds Management Limited ATF Tweed Heads Property Trust's application for an individual exemption from the requirement to hold a retailer authorisation under the National Energy Retail Law at Tweed Mall, corner of Wharf and Bay Street, Tweed Heads NSW 2485.
Background
On 19 October 2022, the Australian Energy Regulator (AER) accepted an application from Elanor Funds Management Limited ATF Tweed Heads Property Trust (Elanor Funds) for an individual exemption from the requirement to hold a retailer authorisation for Tweed Mall.
Submissions were invited from interested stakeholders on Elanor Funds Management Limited ATF Tweed Heads Property Trust's application closing on 16 November 2022. No submissions were received.
Cancellation of Exemption
On 28 November 2025, the AER accepted an application from Elanor Funds Management Limited ATF Tweed Heads Property Trust to cancel this individual exemption, as it intends to cease selling energy to customers at Tweed Mall.
The AER, in accordance with clause 20 of schedule 2 of the National Gas Law (as applied by section 8 of the National Energy Retail Law), has a general power to repeal any decisions it is entitled to make.
Invitation for submissions
We are now seeking submissions from interested stakeholders on the repeal application by COB Friday, 9 January 2026, after which time the AER will approve or refuse the application.
