The 'Review of the regulatory framework for flexible export limit implementation’ commenced on 19 October 2022. Our indicative timetable for the review process is outlined below, noting that our response will be informed by the submissions we receive from stakeholders to the issues paper.

The AER has published an issues paper on the introduction of flexible export limits by distribution network service providers across the National Electricity Market. Flexible export limits can provide the opportunity for consumers to achieve greater value from their consumer energy resource investments (such as solar panels and batteries), through potentially higher levels of export onto the grid. The paper seeks stakeholder views on a range of matters, including:

• the proposed capacity allocation principles and approach to capacity allocation methodology development by distribution network service providers
• consumer participation, whereby we consider both opt-in and opt-out approaches
• the appropriate accountability and governance arrangements for flexible export limits.

As part of its consultation process the AER held an online stakeholder forum on Tuesday 15 November 2022 to provide an opportunity for stakeholders to hear from AER staff and provide feedback.
