On 8 May 2025, Energex submitted a waiver application under clause 5.2 of the Ring-fencing guideline (electricity distribution). Energex requested that the AER waive its obligation under clause 3.1 of the guideline, to allow Energex to install six battery energy storage systems and lease part of the battery capacity to a third- parties. The waiver is proposed to be valid until 30 June 2040.
