AER - Explanatory Statement to AER Non-disclosure Guideline - Electricity Infrastructure Investment Act 2020 (NSW) - July 2026

On 2 July 2026, we published the final Non-disclosure Guideline to replace the 2023 draft Confidentiality Guideline. From that date, the Non-disclosure Guideline applies to network operators making non-disclosure claims over information provided to the AER in connection with our functions under the Electricity Infrastructure Investment Act 2020 (NSW) and the Electricity Infrastructure Investment Regulation 2021 (NSW). 

The accompanying explanatory statement sets out our response to stakeholder submissions received, including how our consideration of these submissions led to further changes between the draft and final versions of the Non-disclosure Guideline.
