Under the national energy laws, the AER may accept enforceable undertakings in addition to, or as an alternative to, other enforcement action to address compliance concerns relating to a power or function of the AER. This enforceable undertaking Guideline provides general guidance for businesses on the following issues:
- an overview of undertakings and the AER’s approach to negotiating, accepting and administering undertakings in connection with its enforcement activities
- the matters the AER will have regard to before deciding whether to accept an enforceable undertaking
- a template undertaking that sets out the AER’s position on terms ordinarily considered in enforceable undertakings and which can be tailored to the facts of a particular matter.
