On 8 April 2016, the Australian Energy Regulator (AER) approved an application from Arc Energy Group Pty Ltd for an individual exemption from the requirement to hold an electricity retailer authorisation under the National Energy Retail Law.
On 27 January 2016, the AER accepted an application from Arc Energy Group Pty Ltd for an individual exemption from the requirement to hold a retailer authorisation under the National Energy Retail Law.
Submissions closed 26 February 2016. No submissions were received.
Cancellation of Exemption
On 13 August 2021, the AER accepted an application from Arc Energy Group Pty Ltd (Arc Energy) to cancel the individual exemption it was granted on 8 April 2016 for the sale of electricity at GM Tower. Arc Energy requested the cancellation of the exemption on the grounds that it no longer owns or operates GM Tower and does not sell electricity at 11-15 Deane Street and 20 George Street, Burwood, NSW.
The AER, in accordance with clause 20 of schedule 2 of the National Gas Law (as applied by section 8 of the National Energy Retail Law), has a general power to repeal any decisions that it is entitled to make.
The process to cancel an individual exemption is similar to the application process. When an application has been accepted it is open to submissions for a minimum 20 business day consultation period, after which time the AER will approve or refuse the application for cancellation.
Invitation for submissions
We are now seeking submissions from interested stakeholders on Arc Energy's application to cancel the exemption by Friday 10 September 2021.
Submissions should be emailed “Attention: Libby Darwin, Acting General Manager, Compliance and Enforcement Branch” at AERExemptions@aer.gov.au with the following title in the email: ‘Arc Energy Group Pty Ltd - cancellation of individual exemption.'
