On 10 November 2025, Ergon Energy submitted a waiver application under clause 5.2 of the Ring-fencing guideline (electricity distribution) ('the guideline'). Ergon Energy requested that the AER waive its obligation under clause 3.1 of the guideline, to allow Ergon Energy to install 24 battery energy storage systems and lease part of the battery capacity to a third-party.  The waiver is proposed to be valid until 31 December 2042.
