In assessing this application, the AER considered the potential for harm to competition as well as the benefit from allowing for these changes to be completed in an orderly way. 

On 22 May 2024, the AER granted a waiver to Evoenergy, to operate the MIST facility.  The waiver will expire on 22 May 2026.
