On 4 December 2025, the Australian Energy Regulator (AER) considered and approved Stockland Property Management Pty Ltd's application to repeal its individual exemption in accordance with clause 20 of schedule 2 of the National Gas Law, as applied by section 8 of the National Energy Retail Law.
Background
On 3 September 2015, the AER accepted an application from Stockland Property Management Pty Ltd for an individual exemption from the requirement to hold a retailer authorisation under the National Energy Retail Law. Submissions closed on 1 October 2015.
On 11 August 2016, the Australian Energy Regulator (AER) approved an application from Stockland Property Management Pty Ltd for Balgowlah Shopping Centre for an individual exemption from the requirement to hold an electricity retailer authorisation under the National Energy Retail Law.
Cancellation of exemption
On 17 April 2023, the Australian Energy Regulator (AER) accepted an application from Stockland Property Management Pty Ltd (Stockland) to cancel the individual exemption it was granted on 11 August 2016 for the sale of electricity at Balgowlah Shopping Centre, 197-215 Condamine Street Balgowlah NSW 2540. Stockland requested the cancellation of the exemption on the grounds that the site is under new management.
The AER, in accordance with clause 20 of schedule 2 of the National Gas Law (as applied by section 8 of the National Energy Retail Law), has a general power to repeal any decisions that it is entitled to make.
The process to cancel an individual exemption is similar to the application process. When an application has been accepted it is open to submissions for a minimum 20 business day consultation period, after which time the AER will approve or refuse the application for cancellation.
Submissions from interested stakeholders on Stockland's application to cancel the exemption closed on 21 May 2024. No submissions were received.
