The AER has published a draft Retail Exempt Selling Guideline and Network Exemptions Guideline (versions 8), alongside a notice of draft decision, for stakeholder feedback.
We have proposed changes to the draft guidelines targeted to:
- reflect new energy rules for secondary settlement points and flexible trading reforms
- reduce unnecessary regulatory burden for commercial embedded network retrofits.
Our proposed changes remove the requirement for:
- exempt sellers to obtain an individual exemption to on-sell energy in a retrofitted commercial embedded network
- prospective exempt network service providers to seek AER approval to register a network exemption to operate or control a retrofitted commercial embedded network.
As part of this process, the AER is also consulting on draft retrofit-specific customer factsheets and a draft explicit informed consent form template.
We invite stakeholders to provide feedback on these documents by close of business on Tuesday 15 September 2026.
