On 2 April 2025, Transgrid submitted an application for a waiver from clause 3.1(b) (legal separation provisions) of the Electricity Transmission Ring-fencing Guideline (the guideline).
The waiver was requested for the purposes of allowing Transgrid to continue to provide telecommunications services not associated with the transmission network to one customer, for a period of twelve months.
Transgrid requested this waiver due to changes that came into effect as part of version 3 of the guideline, which expanded the scope of TNSPs’ legal separation obligations to capture all non-electricity services.
On 17 April 2025, the AER decided to grant a waiver to Transgrid from their obligation to comply with clause 3.1(b) of the Guideline. The length of this waiver is to allow Transgrid additional time to resolve matters with the customer without leaving that customer abruptly without a provider of telecommunications services.
