Under clause 5.6.5A of the National Electricity Code (the predecessor of the National Electricity Rules), the Australian Competition and Consumer Commission (ACCC) was required to promulgate the regulatory test. The ACCC initially promulgated the regulatory test in December 1999. The ACCC released the revised regulatory test in August 2004 following extensive consultation and discussion.
