On 16 December 2015 we received an application from Energex for a waiver from section 1(b) of the Queensland Ring Fencing Guidelines (the Guidelines).

On 11 March 2016 we made a final decision to grant a temporary and conditional ring fencing waiver for Energex's BESS domestic pilot project. Details are set out in our final decision paper.

Background

The application relates to Energex’s Battery Energy Storage System (BESS) trial incorporating photovoltaics. Section 1(b) of the Guidelines requires that a distribution network service provider must not carry on a related business within that legal entity. The glossary to the Guidelines defines a related business as the business of producing, purchasing or selling electricity.
